These Terms and Conditions apply in full force and effect to your use of this website. By using this website, you expressly accept in full all terms and conditions listed below. You must not use this website if you have any objections to any of these Terms and Conditions.

This website is dedicated to and strictly reserved for professional users to the express exclusion of any other use and especially consumer use. By using this website, any user represents and warrants that he/she is acting for professional use and purpose only and so waives any and all right attached to consumer protection in using this website. 

If you are a consumer user, you must not purchase or perform any act related to a purchase on this website or any act on the basis of any information published on this website. Should you infringe or violate these Terms and Conditions, you accept that ARJOWIGGINS will not be liable in that respect.​

1.3 Purpose

The main purpose of this website is to provide information about ARJOWIGGINS creative papers ranges of fine papers and especially provide an international sampling service for papers and envelopes, comprehensive information about merchant locations worldwide, and inform customers about custom-made capabilities.

1.4 Limitation of our Liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our website or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • Use of, or inability to use, our website
  • Use of or reliance on any content displayed on our website.
  • Loss of profits, sales, business, or revenue.
  • Business interruption
  • Loss of anticipated savings.
  • Loss of business opportunity, goodwill or reputation – Any indirect or consequential loss or damage.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked on our website. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any goods by use to you.

1.5 Accounts 

a. Account purpose

Users may choose to create a free account in order to access the following services:

  • Sample orders: Users can place a sample order 
  • Sample orders history: Users can keep track of past sample orders and reorder samples at the click of a button
  • Address book: Users can save multiple addresses to send samples quickly to their contacts.
  • My Projects: Users can create moodboards of papers for their projects and share them with their colleagues and clients.

Accounts are mandatory to make sample orders.

b. Confidentiality

Users who have chosen to create an account are responsible for maintaining the confidentiality of their account and password, and accept responsibility for all activities that occur under their account or password. Users are responsible in all circumstances for the data contained in their personal account or provided during their use of the service.

c. User registration

When registering for an account, the User guarantees that the information provided is accurate. Omitting or falsifying mandatory account information such as name, address or email when registering for an account is not permitted.

d. Termination clause

ARJOWIGGINS reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.

ARJOWIGGINS may vary these general terms and conditions at any time. The general terms and conditions applicable to you are those in force on the date you place an order or log in to this website. ARJOWIGGINS naturally agrees to retain all previous versions of its general terms and conditions and to provide them to users upon request. 

​1.7 Intellectual Property

All elements of this website belong to ARJOWIGGINS or Affiliates of the ARJOWIGGINS GROUP and are protected by intellectual property legislation. You are granted no rights on these elements. 

You therefore acknowledge that ARJOWIGGINS or its assigns may take legal action against anyone who copies, distributes, broadcasts or uses the whole or part of one or more of these elements (even if the elements have been modified) without ARJOWIGGINS’ permission. 

The above protection relates to all text and graphic content on the website, as well as trademarks, the website structure, name, style guide and database.

​1.8 Linking to our website Governing law and jurisdiction

These general terms and conditions are governed by Laws of England and Wales and any dispute will be referred to the Court of London that shall have exclusive jurisdiction over any dispute.​

1.9 Amicable dispute resolution

Unless prohibited by public policy provisions, any dispute that may arise in connection with the performance of these general terms and conditions may be submitted to ARJOWIGGINS for consideration, with a view to amicable resolution, before being referred to a court. A request for amicable resolution will not suspend the time limit for taking legal action.

Should a clause of these general terms and conditions be declared invalid by decision of a court, this will not affect the other clauses, which shall remain in full effect.

No forbearance by ARJOWIGGINS in relying (either temporarily or permanently) on one or more clauses of these general terms and conditions should be construed as a waiver of the right to rely on the other terms and conditions.

2. Online Terms of Sale

 

​2.1 Preamble 

You are solely and fully responsible for your use of the service.

Sales under this website are dedicated to and strictly reserved for professional users. By using this website, any user represents and warrants that he/she is acting for professional use and purpose only and so waives any and all right attached to consumer protection in using this website. You accept that ARJOWIGGINS will not be liable in that respect. Legal action may be taken against you should you infringe or violate these general terms and conditions as a result of which ARJOWIGGINS suffers a loss, or an applicable law or regulation.

​2.2 Products

The images of the products (paper, envelopes, Paper Book etc.) displayed on the website serve an illustrative purpose only. ARJOWIGGINS attempts to be as accurate as possible in showing the colour and texture of its products; please note however that the actual colour and texture may vary from device to device. We would advise you to refer to the actual product before finalising your decision to use that paper.

​2.3 Ordering a sample

Users may order samples of paper and envelopes using the online sampling service. Users must be signed into their account to order samples. Paper book orders are processed separately from sample orders.

a. Samples order limit

Users can order up to 10 different product items per order, paper, boards and envelopes included. For each item, users can order a maximum of 6 samples of a same size. 

If a user places an order for 4 samples of one item, they will receive one labelled sample with all product details, in addition to 4 blank samples. This means the user will receive a total of 5 samples. The labelled sample is provided in addition to the samples ordered, and is therefore not included in the number of samples ordered per item.

b. Adding a sample to the basket

When adding a sample to the basket, users will be asked to choose the specific characteristics of the sample desired: paper weight, watermarked or non-watermarked, sample size or envelope size.

In some cases, ARJOWIGGINS is not able to supply product samples via the online sampling service. In such cases, a contact will be indicated on the website, for the user to request a sample.

c. Availability

In some cases and despite our best effort, some samples might run out of stock.

All products shown on the website are subject to availability. If the User orders a product which is not available at the time of order, the user will be contacted by phone or email as soon as possible. 

​2.4 Prices and shipping costs

The prices indicated on the website are stated in Euros. 

Prices are fixed and will not be subject to any discount, rebate or reduction. ARJOWIGGINS reserves the right to change prices at any time, and those displayed are valid on the order date only and may not apply in the future. 

ARJOWIGGINS sells its Paper Book at a fixed price including VAT and delivery price, regardless of delivery location. 

The prices for samples are inclusive of VAT but excluding shipping costs.  

ARJOWIGGINS charges a nominal shipping cost for each sample order. Shipping costs vary by country and are dependent upon the weight and size of the items you have ordered.  The cost is calculated at the checkout before the User completes their order. Users will be informed of the delivery charge prior to payment.

Standard deliveries include all countries covered by UPS (link to UPS delivery countries). If a User wished to order a sample to be delivered in a country which isn’t served by UPS, they should contact ARJOWIGGINS directly. 

For deliveries outside the EU’s customs territory, please be advised that customs duties and other taxes may apply. You are responsible for completing the relevant formalities and for paying the relevant duties and taxes, as ARJOWIGGINS is in no way responsible thereof. Accordingly, before placing an order, you must check all relevant information and whether it is possible to import your product by contacting the relevant authorities in the country of delivery

2.5 Order processing (in general)

a. Checking out and placing an order

By going to their basket, the User is be able to view the details of the order as well as the unit price of products and the total price of the order. Items may then be removed from the basket, or the order cancelled. Once the order has been confirmed, the User may no longer make changes to the order. 

To be able to place an order, the User must be logged into their account. If the User is not a registered User, they will be prompted to create an account.

Once the User has logged in or registered, they will be asked to confirm the delivery and billing details. The User will then be directed to a secure payment page and asked to pay for the order.  ARJOWIGGINS does not accept postal checks, money orders, purchase orders, bank transfers and PayPal™. 

b. Order acknowledgement

Once the User’s payment has been received, ARJOWIGGINS agrees to acknowledge receipt by email within a reasonable time period. This email will contain confirmation that the User’s order is being processed as well as the details of the order, the products ordered and delivery information. The order acknowledgement indicates that the contract between the User and ARJOWIGGINS has been formed.

All Products shown on our website for sales are subject to ARJOWIGGINS acknowledgement of the Order. ARJOWIGGINS reserves the right to reject any Order without the obligation to assign any reason for so doing. No Order shall be deemed accepted by ARJOWIGGINS unless and until it is confirmed unconditionally by ARJOWIGGINS in the Order acknowledgement.

This website being dedicated for professional use and purpose, no user has right of withdrawal or refund.

2.6 Payment in advance 

Orders must be paid for immediately at the time the order is confirmed. 

You may place an order on this website and pay for your order by bankcard. Payments made by bankcard are secured by RBS Worldpay and ARJOWIGGINS does not have access to any data concerning your bankcard. Payments are made directly to our bank. Any financial costs shall remain at your burden. 

​2.7 Retention of title

Products will remain the property of ARJOWIGGINS until the relevant price has been paid in full, in accordance with this retention of title clause. Risks will however pass to the user upon delivery to the carrier.

2.8 Delivery

a. Sample orders delivery service

All sample orders are prepared, processed and shipped directly from the UK.
For orders placed before 3pm GMT, orders are prepared and processed the same day. For orders placed after 3pm GMT, orders will be prepared and processed at D+1.

Sample orders shipped to the UK are delivered via Royal Mail First Class and as such usually arrive the next day, but this is not guaranteed by Royal Mail. UK customers can also choose one of the UPS delivery options as described below.

Orders shipped outside the UK will be automatically delivered using UPS. Customers can choose between the 2 following options:

  • Express Saver
    • UK: next business day delivery by 12.00 noon
    • Europe: next business day delivery during the day
    • USA and Canada: end of second business day delivery
    • Asia and other locations: between 2 to 3 business days
  • Express 
    • UK: next business day delivery by 10.30am
    • Europe: next business day delivery between 10:30am and 12:00 noon  
    • USA and Canada: second business day delivery between 10.30am and 12.00 noon
    • Asia and other locations: 2 to 3 business days between 10.30am and 12.00 noon

The above delivery times are given by UPS and should be used as a guideline. Actual delivery time may vary depending on local ground/working conditions. 

b. Paper Book delivery 

Paper Books are delivered by 1 or 2 weeks from the order acknowledgement. 

c. Delay

Users are not entitled to compensation, to reject products or to cancel an order on the grounds of a delay. The User may, however, cancel an order that has not been received four weeks after the initial scheduled delivery date for a reason other than force majeure or a reason attributable to the customer, by contacting our customer services department. 

d. Delivery errors and apparent defects 

You agree to check upon delivery that your product is consistent with the product ordered. Complaints regarding a delivery error or apparent defect should be addressed to our customer services department within three days of delivery. Thereafter, you will be deemed to have accepted the product and you may no longer make a complaint regarding a delivery delay or an apparent defect.

e. Partial damage and loss

Products are transported at the risk of users. 

You should refuse to take delivery of packages that are clearly and visibly damaged in order to benefit from the warranty offered by the carrier. You should also notify our customer services department immediately so that a new package can be prepared and dispatched on receipt of the returned damaged package. In such circumstances, the delivery times given above will no longer apply.

Similarly, you should refuse to take delivery of any incomplete package or package containing damaged items. By accepting items delivered by a carrier, you forfeit your right to take any action against the carrier on the grounds of damaged or missing items unless you notify the carrier of the issue and provide relevant details by recorded-delivery letter within three days of acceptance (excluding public holidays). You will forfeit the right to compensation should you fail to complete this formality.
